A number of lawsuits have been filed against Bayer for Xarelto’s side effects and the drug’s poorly researched bleeding risks. Additionally, plaintiffs are filing suit because they were not fully warned of Xarelto’s risks. Lawsuits have been filed against Bayer because of financial hardships associated with the negative effects of Xarelto, emotional turmoil because of caring for loved suffering from medical problems related to the drug and wrongful death.
Within the past year, Xarelto has faced even more scrutiny. In February 2016, the FDA began investigating whether the clinical trial that resulted in Xarelto’s approval was compromised by a faulty blood-testing device. The device was recalled in 2014 because it did not fully report patients’ risk of bleeding— the most common and dangerous side effect of Xarelto. In October 2016, the FDA concluded that Xarelto’s benefits were not skewed by the recalled device used in the trial.
Some studies have concluded that the trial was unaffected by the device’s problems, including results published in The New England Journal of Medicine. However, lawyers for Xarelto patients are claiming the results and subsequent letter—written by Duke University researchers— left out pertinent laboratory data, resulting in the appearance of Bayer’s influence on concealing data. Critics of Xarelto and Bayer question the ethics behind many of Xarelto’s reviews and call for an independent trial to completely assess the safety and efficiency of the drug.
The first Xarelto trial is scheduled to begin in February 2017 in the Eastern District Court of Louisiana. With more than 6,500 cases filed, the prospect of a settlement is believed to be realistic. There is still time to file a case, as lawyers are still filing for patients injured or killed by taking Xarelto.
